What kinds and amounts of medical cannabis are allowed in New York if I am approved?


The approved cannabis products and routes of administration in New York State are:

(1) Liquid or oil preparations for metered oromucosal or sublingual administration or administration per tube

(2) Metered liquid or oil preparations for vaporization

(3) Capsules for oral administration.

Note: Smoking as a method of administration of medical cannabis is expressly prohibited by New York Stateโ€™s Compassionate Care Act, and edible products containing cannabis are not an approved form of medical cannabis in New York State.

The New York Department of Health (NYDOH) determines specific requirements for routes of administration, which are then approved by the Commissioner. Approved routes of administration include liquids and oil for vaporization or administration via inhalation as well as capsules to take orally. Under New York law, smoking is not allowed and the current regulations prohibit the manufacture and sale of edibles.
In terms of quantities, the patientโ€™s certifying physician is required to include the following information on the patientโ€™s certification: the authorized brand and form of the approved medical cannabis, the administration method and any limitations on the use of medical cannabis product. If there is a recommendation regarding dosage, it should be noted on the certification. Recommendations on dosage are not required. The total amount of product recommended and dispensed should not exceed a thirty (30) day supply. The certifying medical professional is responsible for determining the volume of medication necessary to adequately address a patientโ€™s symptoms over a 30 day period. Certifications are valid for up to one (1) year.
In terms of a specific type of cannabis, New York mandated two (2) products for medical cannabis. One product contains an equal ratio of THC to CBD and another contains a low-THC-high-CBD ratio. Each Registered Organization (RO) must offer these two products. Each RO will also offer other products that contain varying ratios of THC to CBD.
