Q&A

I'm a California resident with a medical marijuana card. Can I fly with my medication within California?

I do not know that answer. My guess, however, is no. Have you looked at the TSA guidelines? or called your air carrier?

United Patients group puts it pretty succinctly: "According to federal law the answer is no – you may NEVER fly on a commercial airliner with marijuana or marijuana containing products, even if you have a doctor’s written recommendation for medical marijuana or a medical marijuana identification card. It does not matter if you are flying within state, out of state or out of the country, the answer is always no.

Airports, airspace and airplanes all fall under federal jurisdiction and marijuana, medical or otherwise, is considered illegal under federal law. Therefore, technically, if you choose to travel by plane with medical marijuana, you risk being detained, arrested and prosecuted under federal law even if the state you are departing from allows you to possess and use marijuana legally.

Under federal law, possession of marijuana is punishable by up to one year in jail and a minimum fine of $1,000 for a first conviction. For each subsequent conviction, the sentences and penalties increase."

No way it’s not legal in the sence that rule do not imply it would be considered trafficking if the police really want to hassle you if you got caught because the service starts at the airport are there to stop the drug so no unless it is a written statement by a real doctor from the hospital that’s the only way other than that considered smuggling
