If a prospective patient is under the under the age of eighteen or incapable of consenting to medical treatment, the application can be made by an appropriate person, over twenty-one (21) years of age. There can be two acting designated caregivers who shall be either: a parent or legal guardian of the certified patient, a person designated by a parent or legal guardian, or an appropriate person approved by the Department of Health upon a sufficient showing that no parent or legal guardian is appropriate or available.
